At the request of the Federation of Cane Planters of Brazil (Feplana) and the Northeastern Union of Cane Producers (united), the leader of the Democrats in the Federal Chamber, Efraim Filho (DEM-PB) presented the PL 3149 in the Legislative House, last Friday (5), with the objective of including the independent producer of raw material destined to the production of biofuels at the RenovaBio.
Although the sector is responsible for 30% of the raw material of the ethanol It's from sugar produced by the country's mills, the law did not include sugarcane growers or corn and soybean producers in the right to receive credits (CBios), to be paid for the production of the biofuel. The PL puts an end to such exclusion, as these sectors also begin to share with power plants the operating costs required by the CBios.
The bill also creates regulations to guarantee farmers the co-participation and proportional receipt of the credits corresponding to the production of ethanol of the unit where the raw material was supplied.
“Any structuring of the production of biofuel has, as raw material for the manufacture of fuels, products of animal or vegetable origin, which denotes the great importance of the rural producer in the production chain of biofuels, being of paramount importance that this producer can actively participate in the RenovaBio, mainly with regard to decarbonization credits (CBios)” justifies deputy Efraim by endorsing the election of the Feplana in defense of the 60 thousand suppliers of sugar cane in Brazil and thousands of soy and corn producers.
“The sector sugar cane, for example, must participate in the CBios because a large part of the decarbonization targets will take place in the field, in the sugarcane fields, through actions carried out by the rural producer. This means that this farmer is one of the great economic agents of the RenovaBio“, emphasizes Alexandre Andrade Lima, president of Feplana.
However, as this issue was not included in the law of biofuels, authored by the then Minister of Mines and Energy, Fernando Filho (DEM-PE) in the Temer government, some power plants now do not want to spontaneously share the CBios with independent sugarcane suppliers, as agreed between the entities sucroenergetic during the negotiations for the approval of the RenovaBio. the time, the Feplana already had the support of parliamentarians to defend an amendment in the then PL of the RenovaBio to correct the issue, but the entity declined in the face of the agreement so as not to delay the procedure in congress.
“The PL provides predictability of the participation of the sugar cane at the RenovaBio and fair receipt of CBios based on what you provided cane The power plant and with the total of ethanol manufactured there, even avoiding conflicts of interest regarding the sharing of the CBios with the producer of the raw material”, explains Lima. If the production of power plant is 50% sugar and 50% ethanol, for example, she will receive CBios only related to ethanol and the sharing of this decarbonization credit will have to, proportionally, also take into account the raw material of the independent producer on this production of biofuel.
